This legal theory of a Maori criminal guy I briefly worked and lived with before going to Mexico was interesting. Previously he had made his money mugging women. Specifically he would wait for them to throw their stuff into the back seat of the car and then open the back door, grab the stuff and run like mad. If they resisted in any way he, being unarmed, would beat them up.
The theory was that it was mainly just theft, which is pathetically punished in NZ, and because he was unarmed and only assaulted the women when they used force against him first, it would only be robbery, as opposed to aggravated robbery.
He was right of course and so only got I think 5 years and was out in 3 for an impressive string of crimes, when he would have otherwise expected about 20. Well done I guess.
